Where do I report a technical fault or pages that don't work? foto38 is an interactive online gallery of digital photography. Anyone anywhere can submit photographs; if accepted, photographs are made available for online perusal and, where applicable, purchase. The site soft-launched in 2008. It is owned and operated by jetlagmedia, a small, independent media firm (now) based in Chicago, Illinois, USA.
Where does the name come from? foto38 was conceived, developed and initially operated from Kastanienallee 38, an address in central Berlin, Germany.
The site was programmed with admirable patience and precision by Michael Lambertz, an independent Web developer based in Germany; and, subsequent to him, by Chicago-based programmers Chris Tysh and Ryan Cowan.
What about the quality of the photographs? Well, quality is in the eye of the beholder. The photographs published on the site have been selected according to a range of criteria detailed on the submit page. While we can't offer definitive guarantees about the quality of the photographs themselves, we can (and do) guarantee the quality of prints of any/all photographs you purchase. If you are not satisfied with a print, you can return the print within 15 days* for a full refund**. A quality guarantee also applies to image licensing sales. foto38 warrants to you that its images are free from defects in material and workmanship for the 90-day period following delivery. We will either replace the image or issue a refund of the purchase price in the event of a defect within this time period. * 15 days following receipt of the product; the returned product must be postmarked, not received, within that 15-day period. ** Shipping costs not included.
Can I use the photographs even if I don't license the image? All photographs on the Web site are protected by copyright and can only be used consistent with the regulations detailed on the terms & conditions page. While we encourage you to familiarize yourself with terms & conditions on this matter and others, this regulation is important enough to bear inclusion in this space. Here it is: Please note that all material on this Web site is protected by copyright. You may not copy, reproduce, republish, download, post, make available to the public, or otherwise use foto38 content in any way except for your own personal, non-commercial use. You also agree not to adapt, alter or create a derivative work from any foto38 content except for your own personal, non-commercial use. Any other use of foto38 content requires the prior written permission of foto38 or, in the case of the photographs, the copyright-holding photographer. As noted, this regulation applies to all content on this Web site; that includes all photographs. Students and educators who wish to make a one-time use of an image for a school-related, non-commercial project can do so only with the permission of the copyright-holding photographer. In this event, the image will be made available in a size and resolution consistent with arrangements made between client and photographer. Professionals involved in graphic imaging projects can make use of the images for comping use only (see the question 'What about the watermarks' for further details).

You will notice that some of the photographs on the site are watermarked. This offers a layer of protection to the copyright-holding photographer. If you purchase a photograph, in either a print or image-licensed format, the photograph will not contain this visible watermark. Additionally, if you are involved in a graphic imaging or educational endeavor and wish to make use of a non-watermarked image, you can make those arrangements with the copyright-holding photographer; either he/she or foto38 will provide the image watermark-free, consistent with those arrangements.
Who owns the copyrights to the photographs on the site? Unless otherwise noted, the photographer owns the copyright to all photographs that appear in his/her foto38 published portfolio.
Who are the photographers on the site? As noted above, anyone anywhere can submit digital photographs to the site. None of the photographers whose work currently appears on the site are what you would call professional photographers; they have day jobs in occupations as diverse as graphic design, carpentry, transcription, transatlantic relations and human relations. You can read more about the photographers on their 'about' pages.
Can I contact a photographer directly? If you'd like to contact a photographer you can send a message to contact@foto38.com and we will promptly forward the message to the photographer. The member photographer has no obligation to reply to your message.
Can I submit feedback to the site? Yes. There are several ways to do this. You can write an e-mail. For general questions and comments please e-mail contact@foto38.com. Other more specific e-mail addresses can be found on the site's various information pages. You can also submit feedback via comment forms. Comment forms are available in two places: the guestbook & comments page is a venue for general comments about the site; you can submit specific comments about photographs in the galleries by clicking the 'comment' link on every gallery tour page. English is the preferred language for comment submissions. foto38 will also publish comments in German, French and Spanish. All comments are subject to review and modification, as foto38 sees fit. You can submit a comment at any time. You don't need to have a foto38 user account, or to be logged in if you already have one. You will be asked to include with your comment a name, location and e-mail address. (The e-mail address will not be published on the site; your name and location will be.) If you have submitted a comment, it should appear on the site within 24 hours' time. All comments are subject to review and modification, as foto38 sees fit. Comments can also be rejected. Rejected comments will have in some way violated the legal terms of comment submissions; comments are never rejected on editorial grounds. Do I need to create a user account in order to browse the photo galleries? You don't need to create a user account if you're just browsing the galleries. If you'd like to bookmark or purchase a photograph, you will need to create a user account. Creating an account is easy. As soon as you click either the bookmark or purchase option on any gallery tour page you will be asked to create a new account or to enter user name and password for an existing account. We ask that your user name be your e-mail address; the password is yours to create. There is no obligation that you keep a user account active; if you create an account and never visit the site again, the user name and e-mail will eventually expire. foto38 will use the information you submit consistent with our privacy policy. If I create a user account, do I have any obligation to buy anything? Are there any membership or hidden costs involved? The answer to both questions is no.

How can I keep up to date on new photo galleries and the like? We're glad you asked! You can always visit the Web site and see for yourself what's new. The home page lists recently added photographers and galleries. Additionally, you can sign up for fortnightly (that's every two weeks) e-mail updates. You can add your name to the e-mail update list on the home page.

Access by you to your personal information is available through a password and the user name (e-mail address) that you provide upon registration. Credit card transactions are handled by a third-party provider.
Where do I report a technical fault or pages that don't work?
